According to the SEM, “if the applicant comes from a region to which forced repatriation would be difficult, if not impossible, the requirements must be increased accordingly”1. The list of readmission agreements concluded by Switzerland can be consulted on the SEM website.
This requirement (which is not included in the law) constitutes discrimination (a priori accepted by courts) based on origins. This is why we can connect it with the federal approval procedure which establishes a list of countries that constitute a “migratory risk”.
